NOTICE TO RESIDENTS OF CALIFORNIA, U.S.A.

This notice is issued in accordance with the California Consumer Protection Act, as amended by the California Privacy Rights Act (collectively, “CPRA”).

As used in this notice, “Company” means MOL Logistics (USA) Inc. This notice may also use the words “we,” “us” and/or “our,” each of which shall refer to this Company. “You” or “your” refers to each California resident covered by the CPRA.

Part I of this notice applies to (i) residents of California who are either actual or potential customers or vendors of this Company, (ii) residents of California who represent businesses that are either actual or potential customers or vendors of this Company, (iii) residents of California who are employed by Federal, State or local governmental agencies that communicate with this Company, and (iv) residents of California who otherwise interact with this Company.

Part II of this notice applies to residents of California who are applying for work with this Company or who are already working with this Company, either as employees or as outside contractors.

Part III of this notice contains information applicable to all residents of California and notifies them of their rights under the CPRA.

PART I

Whenever you communicate with us, whether in person, by phone, by mail or over the internet, we may collect personal information, including sensitive personal information,1 about you and/or your business, such as your name, telephone number, post-office address, and internet address. We may also collect information about the nature of your business. We may use this information and any shipment information you provide to facilitate our business as a provider of transportation services.

Whenever you request us to arrange transportation services, shipment information that you provide, which may include personal information, will be disclosed (i) to governmental agencies as required by law, (ii) to our agents and our subcontractors involved in the transportation services, including but not limited to owners, operators or charterers of ocean vessels, and/or (iii) to other subsidiary companies of our parent,

Mitsui O.S.K. Lines, Ltd. Any such disclosure shall be made solely for purposes of facilitating our transportation services.

We will not sell your personal information to others. Except as provided above, we will not share your personal information with others.

PART II

Residents of California who apply for positions with this Company, either as employees or as outside contractors, will be required at the time of their application to disclose certain personal information (this requirement also applies with regard to Residents of California who apply as, or on behalf of, outside contractors). Such disclosure is required so that we may evaluate your suitability for a position, and also to satisfy our legal obligations. If you are hired, all personal information that we collect, either during the application process or during any period of employment (as an employee or as an outside contractor), will be used to process you for employment, to facilitate the work, to evaluate your performance, and/or to comply with legal obligations.

We may disclose your personal information to other subsidiary companies of our
parent, Mitsui O.S.K. Lines, Ltd., for the purpose of determining your potential suitability for possible employment or for a possible outside contractor role with one or more of them. If you accept employment with us (as an employee but not as an outside contractor), we may share your personal information with third parties to enable us to provide you with fringe benefits to which employees may be entitled.

We will not sell any of your personal information to others. Except as provided above, and except as is reasonably necessary to facilitate our transportation services, we will not share your personal information with others.

More specific information concerning the categories of personal information to be collected and, if applicable, to be disclosed to third parties, may be provided at the time of collection and in accordance with any separate request made under Part III of this notice. In addition, employees of this Company shall be provided with a separate employee privacy policy notice for California Residents.

PART III

Your CPRA rights are subject to (i) certain exceptions and limitations set forth in the
CPRA, and (ii) our legal obligations. Your rights are as follows:

  • the right to a notice, at the time of collection, describing the personal information we will collect, the sources of the information collected, and how it will be used
  • the right to access your personal information
  • the right to delete your personal information
  • the right to limit the use and disclosure of sensitive personal information, as defined in Appendix B
  • the right to know what personnel information, if any, may be sold or shared, why it may be sold or shared, to whom it may be sold or shared, and the right to opt out of the same
  • the retention period of the business for each category of personal information
  • the right to correct inaccurate personal information
  • the right not to suffer discrimination because you chose to exercise any of these rights

We will respond to requests within the time allowed by the CPRA, unless we are unable to verify your identity.
